PERSONAL DATA PROTECTION RULES

TERMS AND DEFINITIONS

"Application" — an application «VIEWAPP» for mobile operating systems Apple iOS, Android.

"User" — an individual who has duly joined the User License Agreement located at: Privacy Policy .

"Company - Contractor" — VIEWAPP S.L., registered under the main state registration number B56473309. The application was published in the shops of mobile applications on behalf of the Contractor Company, which is the developer of the product system.

"Company - Customer" — a company that:

  • provides services to the User;

  • carries out marketing communication with the User using the Application;

  • changes the content of the Application.

  1. GENERAL PROVISIONS

    1. The application is a program developed for mobile devices running Apple iOS, Google Android operating systems.

    2. These rules are open and publicly available document. The current edition is located on the Internet at: Privacy Policy

    3. These Rules for the protection of personal data and the use of cookies describe the processes of using your Personal data by the Contractor Company and its affiliates anywhere in the world, both actively and passively. We may collect Personal Data from you while you:

      • are using one of the Mobile Phone Applications;

      • use the support site and/or the site for managing data accumulated by the Application or provided by the Company by the Customer;

    4. We collect your Personal Information for all of the following categories:

      • Application users;

      • visitors to any site directly linked to the Application;

    5. The application transmits data to the server of the Contractor's Company https://viewapp.io/, including the data required for authorization. The app uses your phone number as a key identifier for authorization, unless another option is selected to sign in to the app. A complete list of collected data is listed below, in the section "TYPES OF DATA COLLECTED".

    6. By accepting the terms of these rules, the User also accepts the terms of the User License Agreement, the current version of which is located on the Internet at: User License Agreement

    7. Applications, suggestions and claims of individuals and legal entities to the Company to the Contractor related to the content and operation of the Application, violations of the rights and interests of third parties, the requirements of the legislation of the Spain, as well as for inquiries of persons authorized by the legislation of the Spain, can be sent to Vía de las Dos Castillas 33.     8. If the User disagrees with the terms of these rules, the use of the Application must be terminated immediately.

  2. TYPES OF DATA COLLECTED BY US

    1. We collect both "Personal, or contact, data" and "Anonymous data" about users and visitors.

    2. Contact data and personal data — information that identifies you, as well as information associated with such data. "Anonymous data" is information that cannot be used to identify you, it is not associated with data that can be used for these purposes. They include passively collected information about your actions on the site or in the Application, for example, data about the fact and how you use their functions, to the extent that the information is not associated with your personal data.

    3. Types of data collected, purposes and ways of using the data.

      • your full name. This information is collected by the Application by inputting this information to the user during registration or during filling under "User Profile". The full name is transferred to the server of the Contractor Company and becomes available to the Customer Company.

The email address is transmitted to the server of the Contractor Company and becomes available to the Customer Company. The Contractor Company has the right to send service and information messages to the email address.

      • phone number. This information is collected by the Application by entering this information by the User during registration. The phone number is transmitted to the server of the Contractor Company and becomes available to the Customer Company. The phone number is the main identifier of the Application User. The Application uses the phone number to send SMS — messages that are used to identify the phone number for password recovery, as well as for confirmation of critical actions, such as the confirmation of the results of any inspection. The collection of this information is mandatory.

      • password. This information is collected by the Application by entering this information by the User during registration. The password is transmitted to the server of the Contractor Company and is used to authenticate the User in the Application. After the password is received by the server, its alphanumeric form is transformed into the md 5 code and is not available for viewing and editing by any other users of the Application.

      • mailing address. This information is collected by the Application by entering this information by the User when performing an inspection. The postal address is transmitted to the server of the Contractor Company and becomes available to the Customer Company. The Contractor Company has the right to send service and information messages to the postal address.

      • IP address. This information is collected by the Application during authorization and inspection in the Application. The information is collected for statistical and security purposes.

      • profile photo. This information is collected by the Application by entering this information by the User during registration or when filling out the "User Profile" section. The profile picture is transferred to the server of the Contractor Company and becomes available to the Customer Company. This information can be used to identify the User by the Customer Company and the Contractor Company.

      • Location. The Precise Location and Coarse Location are collected by Application during the inspection. Information is collected in order to determine the address of the location of the inspected object. Location is transmitted to the server of the Company, the Contractor and and becomes available to the Customer Company.

      • User Content (Photos or Videos; Audio Data; Customer Support; Text and Graphic Content). User content is collected by the application by taking photographs, filming, recording audio, entering text information into the fields of the application. This information is collected during the inspection according to scenarios developed by the Contractor Company and the Customer Company. This content is transferred to the server of the Contractor Company and becomes available to the Customer Company. The creation and transmission of User Content is the main purpose of the Application.

      • Identifiers. During use, the Application collects identifiers, in particular the device ID. This data is transferred to the server of the Contractor Company and becomes available to the Customer Company. The data is used to determine the ID of the device on which the Application is used, as well as the name of the device manufacturer, type and version, and its operating system.

      • Usage data. The Application collects Usage Data, in particular product interaction data and other usage data. Such data is transmitted to the server of the Contractor Company and is used to parse and fix errors.

      • Diagnostic data. The app collects data automatically Diagnostics, in particular crash data, performance data, and other diagnostic information. Such data is transmitted to the server of the Contractor Company and is used to improve the operation of the Application, as well as to analyze and correct errors.

    4. When accessing certain sections of the site and the App, we passively collect certain information from your devices, including your IP address, screen resolution, geographic location, Wi-Fi, browser, unique device identifier, if any, and (or ) mobile operating system, and use third-party service providers to obtain detailed analytics. We also collect geolocation data from users who scan the App.

    5. Voluntarily Shared Data. We collect information that you provide to us in the course of using the App and/or App-related sites. Some examples:

      • personal data that you provide when registering or using the Application, including full name, email address, phone number, username (login), password, mailing address, IP address, profile picture and profile data. Providing certain types of this data (specified by us) is mandatory in order to create an account or use our services;

      • exchanging messages with us (for example, via email, via messages and photos in applications, via text messages);

      • information that you provide to our customer support service or other employees or representatives of the Contractor's Company or the Customer's Company, by regular mail, in the Application, by means of a text message, Facebook messenger or any other messenger, messages within the Application, by phone or otherwise, and the Customer Company or the Contractor Company may keep a record of such interaction in order to respond to your request and improve the quality of the service, and we may record your conversations with the support service in order to ensure the quality and improve the service;

      • the data you provide, including photos and comments, as feedback, through profile forms or when solving problems in the Application or on sites related to the Application;

    6. If you use one of our sites, we automatically collect information about you, including your hardware model, browser type, operating system, Internet Protocol (IP), and domain name. If you are using a mobile device, we may also receive your unique identifier and information about the mobile operating system. We may match this information with your other Personal Information that we hold. We may also use cookies and URL information to collect information about the date and time you use our services.

    7. In the course of your use of the Application, we may use third-party services, such as Google Analytics, to track and analyze trends and consumer behavior patterns.

    8. Because our servers depend on third-party commercial software and programs, we may inadvertently collect Personal Data due to certain automatic features or properties of such software, or due to certain changes or updates to the software. We will use reasonable efforts to remove any such information prior to such interaction and after it is found on our system. If you are aware of such inadvertent collection of data, please inform us immediately so that we can take the necessary steps to remove such information from the system.

    9. We collect information about the device you use to access the App and/or linked sites, and such information may contain Personal Data. This information is used to recognize your device to link to your account. These actions are taken to ensure security, evaluate the performance of the Application or linked sites, improve and optimize the quality of customer service, and prevent fraud. These may include sharing information about your device, including limited personal data, IP address, Wi-Fi and location information, with a third party service provider.

    10. The battery and network performance (such as battery status and charger usage) of your device, and the file names, types and sizes of files on your device, including the amount of free and used space on local storage, but not the contents of the files; and system status, including information about device events such as system crashes and activity.

  3. SECURITY AND DATA STORAGE

    1. The Contractor has implemented administrative, physical and technical measures to protect your data from unauthorized access and modification. The Company will comply with applicable law in the event of any breach of the security, confidentiality or integrity of your Personal Data and, if such a step is deemed appropriate or required by applicable law, will notify you by e-mail, SMS or through prominent publications on the site as soon as possible and without unreasonable delays, provided that such actions will comply with legal requirements of law enforcement agencies or any measures necessary to determine the extent of the violation and restore the integrity of the data system to an acceptable extent.

    2. While security cannot be guaranteed either on or off the Internet, we make commercially reasonable efforts to ensure that such data is collected and kept secure in accordance with this Privacy Policy and all applicable laws and regulations.

    3. If the Contractor Company has provided you (or you have chosen) a username, login or password that allows you to access certain sections of the Application and/or sites related to the Application, you are responsible for the confidentiality of this information. We ask you not to transfer your username, login or password to anyone and not to use the same password for different services.

    4. The Contractor Company restricts access to your Personal Data to the circle of persons who need it to process data on behalf of the Company. In cases where such persons are our employees, they are bound by confidentiality agreements, and the Contractor Company will take appropriate action (up to disciplinary proceedings) if it turns out that the employee (s) did not comply with the security standards of your Personal data. The Contractor Company cannot take responsibility for employees or other representatives of the Company who operate outside the normal work activity or the terms of the contract concluded with them, or any third parties to whom your Personal Data may be transferred if such persons act outside the terms of our contracts with them.

    5. We store your Personal Data only as long as it is necessary to achieve the purpose (s) for which it was collected and as required by applicable law.

    6. This generally means that we keep your data for the entire life of your account with us or as long as it is required to provide the services, unless we have a legitimate reason to keep it for a longer period of time (for example, after the contract has been completed in full, we may still have a legitimate interest in using your contact information for marketing purposes). We also store data necessary to complete unfinished tasks and data necessary to address your complaints or requests or to exercise our legal rights and requirements, as well as certain data that we are required to keep for a period of time established by law. If certain data is only stored due to a legally binding storage period, then the processing of such data by us is limited, even if you did not make a specific request.
